Furever Studio – Terms of Use

1. Use of the Service

Furever Studio allows users to upload images and generate derivative content using automated systems. You may use the Service only in compliance with these Terms and all applicable U.S. laws and regulations.

2. User Responsibilities

2.1 Lawful Use

You are solely responsible for the content you upload or generate. You agree not to use Furever Studio for unlawful, harmful, defamatory, harassing, deceptive, or misleading purposes.

2.2 Permissions for Uploaded Images

You represent and warrant that:

• you own or have the legal right to upload any images or content you submit;
• you have obtained written, verifiable permission from every identifiable person appearing in any image you upload;
• your upload and use of such images do not violate any third-party rights, including privacy, publicity, likeness, copyright, or data protection laws.

Furever Studio relies entirely on your representations and does not verify these permissions. You assume full responsibility for failure to obtain proper consent.

3. License to Furever Studio

By uploading images or generating content, you grant Furever Studio a limited, non-exclusive, worldwide, royalty-free license to:

• store, process, and use your uploaded content to operate the Service;
• generate derivative content as directed by you;
• use uploaded and generated content internally only, for debugging, quality assurance, security, misuse detection, and Service improvement.

Furever Studio does not use uploaded images or generated content:

• to train machine learning models;
• for public, commercial, or promotional purposes;
• for external data sharing.

Uploads are retained for one hour, then deleted. Final generated content may be stored indefinitely unless deleted upon request.

Furever Studio does not claim ownership of your uploaded images or generated content.

4. Ownership and Permitted Use of Generated Content

4.1 User Ownership

You own the rights to the content generated through Furever Studio, subject to these Terms.

4.2 Restrictions on Use

You may not use generated content:

• to violate any person's publicity or likeness rights;
• for unlawful purposes, harassment, defamation, impersonation, or deception;
• in ways that infringe third-party rights;
• to mislead others about the origin or authenticity of the content.

4.3 Internal License to Furever Studio

You grant Furever Studio a limited license to store and internally use generated content for debugging, quality control, security, and improvement of the Service. Furever Studio does not publicly use or distribute your generated content.

5. Deletion and Removal Requests

5.1 User-Initiated Deletion

Users may request access to or deletion of their personal information or generated content by emailing Furever Studio at contact@furever.studio. Furever Studio may verify your identity before processing requests. Deletion requests will be honored within a reasonable timeframe.

5.2 Requests by Non-Uploaders

If an identifiable individual appears in generated content but was not the uploader, Furever Studio will evaluate deletion requests case by case, which may include:

• requesting identification;
• confirming likeness;
• assessing potential misuse, harm, or unauthorized use.

Furever Studio may decline removal requests made in bad faith or without sufficient basis.

6. Prohibited Conduct

You may not:

• upload images without the required written permissions;
• harass, defame, or harm others using the Service;
• attempt to reverse-engineer or disrupt the Service;
• use automated tools to extract data;
• submit unlawful or abusive content.

Furever Studio may suspend or terminate access for violations.

7. Personal Information and Communications

Furever Studio collects and uses personal information in accordance with the Furever Studio Privacy Policy. By using the Service, you consent to receiving product updates, announcements, and promotional messages. You may unsubscribe from marketing communications at any time.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. Furever Studio disclaims all warranties, express or implied, including any warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.

Furever Studio does not guarantee uninterrupted or error-free use of the Service or accuracy of generated content.

9. Limitation of Liability

To the fullest extent permitted by law:

• Furever Studio shall not be liable for any indirect, incidental, consequential, or special damages;
• Furever Studio shall not be liable for any claim arising from misuse of likenesses, failure to obtain proper permission, or third-party claims related to uploaded or generated content;
• your exclusive remedy is to stop using the Service.

10. Indemnification

You agree to indemnify and hold harmless Furever Studio and its owners, employees, and affiliates from any claims, damages, liabilities, or expenses (including attorney's fees) arising from:

• your uploaded content;
• your generated content;
• your violation of these Terms;
• your violation of third-party rights.

11. Arbitration and Governing Law

11.1 Binding Arbitration

Any dispute arising out of or relating to the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Judgment may be entered in any court of competent jurisdiction.

11.2 Location

Unless required by law, arbitration occurs in California. The arbitrator may conduct proceedings remotely, sufficient to establish venue.

11.3 Governing Law

These Terms are governed by the laws of the State of California.

11.4 Opt-Out

You may opt out of arbitration within 30 days of first using the Service by contacting us at contact@furever.studio.

11.5 Small Claims

Either party may bring a claim in California small claims court.

12. Modifications

Furever Studio may update these Terms. Continued use after changes constitutes acceptance.
